Terms of Business
By booking a tour or service with Desmond Tours, you agree to the following Terms of Business:
Booking Process
- In order to book our services, a deposit must be paid by the customer. Tour dates cannot be guaranteed without a deposit payment. Unless otherwise agreed, the tour deposit is €100 per day of touring. Deposits for accommodation bookings are charged separately.
- Our ‘Book with Peace of Mind‘ policy, offers added flexibility to re-book your tour, re-using your deposit.
- Your deposit is non-refundable, except in the case of cancellation of the tour by Desmond Tours.
- The full balance of the tour including accommodation payments are due 28 days (4 weeks) prior to the start date of the tour.
- If the full balance of the tour price is not received within 4 weeks of the start date of the tour, Desmond Tours reserves the right to cancel the booking.
- All our services are charged for in our local currency (Euros).
Modification or Cancellation of a Tour by Desmond Tours
- We endeavour to operate all our tours as advertised. However, we reserve the right to modify any tour, for example in the event of the booked driver guide and/or vehicle not being available, we reserve the right to arrange for a substitute driver guide and/or vehicle of the same standard.
- A “driver guide” is unless otherwise specified one person and is both your driver and guide.
- In the event that Desmond Tours has to cancel a tour, the customer shall receive a full refund of the monies paid to us but will not be entitled to any further sum by way of compensation, damages or otherwise arising from said cancellation. This applies no matter when the tour is cancelled.
- Force Majeure: Where war or terrorist activities, threatened or actual, civil unrest, industrial action, threatened or actual, weather conditions, pandemic, fire, flood, drought, airport regulations or closures, unforeseen alterations to public transport schedules and rescheduling of aircraft or any other event outside the control either delays or extends the tour or compels a change in prior arrangements, Desmond Tours cannot accept liability for any resulting loss, damage or expense to the customer.
Customer Cancellation or Modification
- On a general note, we strongly recommend that you take out your own travel insurance
- The customer may cancel up to 28 days before the tour start date and choose one of the following options:
You may have your tour deposit payment transferred to a future booking, and any remaining amounts paid will be refunded to you. Please note that accommodation deposits cannot be returned as these are paid directly to our suppliers.
You may opt for a gift voucher to the value of your tour deposit payment, which can then be transferred to another person. Any remaining amounts paid will be refunded to you. Please note that accommodation deposits cannot be returned as these are paid directly to our suppliers.
We are also happy to change all participant names on a booking, so that there is full flexibility regarding who can join the tour (please note maximum numbers apply as per the original booking, due to vehicle capacity).
The tour deposit payment which we retain for you must be used within two years of your cancellation date. The new booking must be for the same duration as, or longer than, the original booking.
- Should the customer cancel the tour less than 28 days before their tour start date, refunds do not apply and the booking deposit cannot be re-used.
- Where the customer wishes to modify the tour arrangements after Desmond Tours had confirmed the booking, any additional costs that have been incurred by Desmond Tours, will be charged to the customer.
- A booking is valid for the amount of people indicated in the original booking confirmation. If, for any reason, you wish to amend your group size, you must contact us by email and we will try to make arrangements, which will be subject to availability.
- You need to notify us by email about any changes to your arrival or departure times. We cannot be responsible for any cancellations of all or part of your tour or for any delays or expenses which arise as a result of such changes in arrival or departure times.
Desmond Tours’ Liability to the Customer
- Although we take the greatest care to ensure that everything runs smoothly on your trip, accidents can happen. For this reason, we strongly encourage you to take out adequate insurance cover prior to travel for loss or damage to personal property, personal injury or illness, medical expenses and cancellation expenses. Please note that neither Desmond Tours, its employees nor its agents can accept any liability relating to personal injury or illness, loss or damage to personal equipment, or any other unforeseen events that occur during your tour.
- Unless previously arranged, Desmond Tours will not provide child seats. According to EU regulation children under the age of twelve, and shorter than 4’5″ must use a child seat to travel in a vehicle. It is your responsibility to let us know if anyone on board requires a child seat.
- You must let us know about any mobility issues when booking your tour. It is your responsibility to let us know if anyone on board requires a specifically adapted vehicle or special assistance.
- Luggage is carried at the owner’s risk throughout the tour unless insured. Hand baggage and personal items such as but not limited to coats, cell phones, umbrellas and cameras are entirely in the care of the participants.
- It is your responsibility to have all necessary visas, passports, permits and certificates required for your selected itinerary and to comply with all applicable laws.
- Any imagery/media which you capture and share with us (e.g. either by email or on social media), may be used by Desmond Tours without charge. Similarly, during your tour, your tour guide may take photographs and films of you for bona fide promotional or marketing purposes, i.e. for website use, brochures or on social media. If you prefer not to be featured, you must indicate this to us in writing by sending an email.
- Our website contains statements representing its honest belief that the facts as shown are correct.
- All offers are subject to availability.
Third Party Bookings
- Unless otherwise arranged, your tour does not include entry to any visitor centre, business or other third-party service which we may visit or use during your tour.
- All additional bookings must be made by you in advance of the visit where required by the third-party business. It is your responsibility to manage those bookings i.e. using correct names for tickets, retaining tickets and having them with you, as required.
- Special Requests, such as diet, room location, twin or double bedded room, or a particular facility, should be indicated in writing at the time of booking. Where special requests relate to components of a tour operated by a third party such as a hotel etc., we will pass your request on to the hotel or other third party supplier but cannot guarantee that it will be accommodated.
Additional Charges and Exclusions
- Additional charges apply for transfers before 8am and after 10pm. This is to cover additional expenses for driver accommodation, so we can ensure that your driver guide is well rested for your tour.
